This is a production-ready draft for app launch, but it should still be reviewed by a qualified lawyer in Maharashtra, India before public release.
1. Acceptance of Terms
By creating an account, using ModVala, posting content, uploading media, tracking trips or using premium features, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app.
2. Eligibility and Account Responsibility
You must be legally capable of using the app under Indian law and applicable platform rules. You are responsible for keeping your login details secure and for all activity under your account. You must provide accurate account and vehicle information and keep it updated.
3. What ModVala Provides
ModVala provides tools for vehicle profiles, garage media, expenses, budget tracking, maintenance reminders, mods discovery, trip tracking, location labels, album posting, community participation, likes, comments, follows, notifications and premium features. Some features may be local-only, beta, limited, paid, subject to approval, or dependent on third-party services.
AI and Machine Learning Features
ModVala may use AI and machine learning technologies to support features such as mods recommendations, search ranking, community moderation assistance, and trip analysis. Automated systems do not make legally significant decisions about users without human oversight.
4. Vehicle, RC and Lookup Information
RC or number-plate detection is optional and may be best-effort. Lookup failures must not block profile creation. You are responsible for confirming vehicle details before relying on them. ModVala is not a government vehicle verification service and does not provide legal proof of vehicle ownership.
5. Trip Tracking and Location
Trip tracking depends on GPS accuracy, Android permissions, battery settings, device hardware, internet access and third-party map/search providers. Distances, fuel estimates, fuel prices, route calculations, auto-stop and reminders are estimates. Do not use ModVala while driving in a way that distracts you or violates traffic law.
6. Fuel Rates, Costs and Financial Estimates
Fuel prices, trip costs, budget projections, maintenance costs and mod prices are estimates or user-entered values unless clearly shown otherwise. ModVala is not financial advice, insurance advice, tax advice, loan advice or a repair quotation.
7. Mods, Sellers and Third-Party Links
Mod search results, seller badges, buy links, images, prices and fitment notes may come from third-party websites, APIs, sellers, admins or user submissions. You must verify compatibility, authenticity, warranty, legality and safety before purchasing or installing any mod.
8. Community Rules
You may upload albums, photos, videos, trip posts, captured-location posts, comments and profile content. You must follow the Community Guidelines. ModVala and community admins may approve, reject, hide, edit labels, remove posts, restrict accounts or ban users for safety, abuse, illegal content, spam, harassment, IP infringement, privacy violations or policy violations.
9. User Content Licence
You keep ownership of content you upload. By posting or sharing content in ModVala, you grant ModVala a non-exclusive, worldwide, royalty-free licence to host, store, process, display, resize, moderate, distribute within the app, promote and make that content available as needed to operate ModVala.
10. Prohibited Conduct
- Do not post illegal, abusive, hateful, explicit, violent, harassing, fraudulent or misleading content.
- Do not upload private data about others without permission, including exact home/work locations, phone numbers, IDs, RC details or owner data.
- Do not impersonate another person, brand, seller, admin or community.
- Do not scrape, reverse engineer, overload, exploit or attack the app, APIs, Supabase, Google services or other systems.
- Do not use ModVala to promote unsafe or illegal vehicle modifications, street racing, reckless driving or evasion of law.
- Do not use ModVala to promote, plan, or facilitate any activity that violates the Motor Vehicles Act, 1988, including illegal racing, driving without a licence, or operating an unregistered vehicle.
- Do not submit false seller verification, fake products, fake reviews or fake community engagement.
11. Premium Features, ModVala Pro and Credits
ModVala offers a paid subscription called ModVala Pro, sold through Google Play Billing using RevenueCat as payment-management provider. Pro is currently priced at Rs 99 per month and includes a monthly allowance of in-app credits, additional garage capacity, advanced charts, PDF/Excel exports and other benefits described inside the app.
ModVala also uses a two-bucket in-app credit system (Free credits and Premium credits) to gate certain actions such as joining or creating Gang Trips, AI Mechanic questions, photo decor, additional vehicles, vehicle QR codes and data exports. Free and Premium credits, monthly allowances, action costs, bonus rules, credit packs, expiry, carry-forward and refund handling are described in full in the ModVala Credits Policy, which forms part of these Terms.
Pricing, validity, renewal and refund handling for Pro and credit packs are governed by Google Play's billing and refund policies and by the Credits Policy. By subscribing to Pro or purchasing credit packs you agree to those terms.
12. Admin and Community Owner Powers
App admins may manage any community, post, seller/mod record, approval queue, report or policy issue. A community creator may manage only their own community subject to ModVala's final control.
13. Intellectual Property
ModVala's name, logo, design, app code, features, brand assets and content generated by ModVala are owned by ModVala or its licensors. You may not copy, clone, resell, rebrand or misuse ModVala assets without permission.
14. Account Suspension and Termination
ModVala may suspend, restrict or terminate accounts for violations, fraud, security risk, legal requests, abuse, non-payment, repeated rejected posts or harm to users/community. You may stop using the app and request account deletion at any time.
15. Disclaimers and Limitation of Liability
ModVala is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, ModVala is not liable for indirect, incidental, special, consequential or punitive damages, loss of data, loss of profits, vehicle damage, third-party seller disputes, travel issues, GPS errors, user content, community disputes or unsafe user actions.
Force Majeure
ModVala shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, government actions, internet or network failures, third-party service outages, or acts of God.
Changes to These Terms
ModVala may update these Terms at any time. Where changes are material, ModVala will provide at least 7 days' prior notice via in-app notification or email. Continued use of the app after the effective date of updated Terms constitutes acceptance.
16. Governing Law and Maharashtra Jurisdiction
These Terms are governed by the laws of India. Subject to mandatory consumer and statutory rights, disputes may be subject to competent courts or forums in Maharashtra, India. Nothing in these Terms limits your rights under the Consumer Protection Act, 2019, or any other mandatory Indian statutory right.
